Decree of Divorce Related Information
Marital standing at year end determines your filing status for the entire year. If you have a decree of divorce or separate maintenance, signed by a judge, you should file as single. Regardless of whether you have a signed decree you may be able to file as head of household.

Under New York State law, those seeking a divorce must establish either abandonment, constructive abandonment, cruel and inhuman treatment, adultery or imprisonment. If a plaintiff does not have grounds for a divorce, the couple could enter into a separation agreement, live separate and apart for one year under the terms of the agreement and then seek to convert the agreement into a divorce decree.
When filing for a death certificate in New Jersey, a child over the age of 18 should provide a birth certificate showing the missing loved one's relationship to the child, proof of the death or divorce of the spouse (such as a death certificate or divorce decree), and photo identification.
30 July, 1996, the President signed into law the Taxpayer Bill of Rights 2, (P.L. 104-168). Section 401 of P.L. 104-168 directed the GAO and the Department of the Treasury to study the innocent spouse issue and report back to Congress within six months. Specifically Treasury was instructed to report on the effects of providing that, if a divorce decree allocates liability for tax on a joint return filed before the divorce, the Secretary may collect such liability only in accordance with the decree.
In Missouri: X needs to obtain a new driver license since she has just divorced. Her current driver license says “X” but she would like to revert to her maiden name, “Y” If X brings in her birth certificate, she will also need to show an official copy of her marriage license AND an official copy of her divorce decree. This shows X’s history of name changes. If X has a valid U.S. Passport that has her name as “X,” she must bring in a copy of her divorce decree to show that her name has now changed to her maiden name, Y.
