About Wisconsin Unclaimed Property Law
Wisconsin Unclaime Property law was enacted in 1970 to protect unclaimed property and return it to its rightful owners or their heirs
The law stipulates that unclaimed property holders in Wisconsin, such as banks, insurance companies, credit unions, businesses, etc., must make a determined effort to locate the true owner. If efforts fail, they must report the names and last known addresses of the owners to the Office of the State Treasurer, who then publishes the notice listing the unclaimed property owners names in newspapers throughout the State.
In Wisconsin there is no time limit for claiming the abandoned money by its rightful owners or by their heirs.
Similar laws exist in all 50 USA states.

Requirements for Locators of Missing Owners/Heirs in Wisconsin. (based upon sec. 177.35, Wis. Stats.).
Individuals and businesss engaged in locating unclaimed property owners and assessing a finder's fee for their services doing this business in Wisconsin should be aware of the several statutory and departmental requirements imposed for the unclaimed property locating related activity:
- The locator fee is limited to 20% of the value of the property.
- Agreements to pay compensation between locators of missing owners and any owner/heir are not enforceable until 12 months after the date the property is remitted to the State Treasurer.
- Any agreement to locate, deliver, recover or assist in the recovery of property presumed abandoned which is entered into by or on behalf of the owner of the property must:
- Be in writing.
- Include the notarized signature of the owner.
- Include the owner's name and present address.
- Include a description of the property.
- Include the value of the property.
- Include a statement of the fee or other compensation to be paid by the owner, which may not exceed 20% of the actual value of the property recovered.
- Include a clear and prominent statement disclosing the name and address of the holder and whether the property has been paid to the State Treasurer.
- Every claim filed with the Wisconsin Treasurer's Office must include the following:
- The official claim form.
- A signed and notarized contract including all information as described in item (3) above.
- Documentary evidence of ownership.
- All claims will be paid directly to the owner and the agent (locator) will be responsible for collecting any "finder's fee" from the owner.
- All claims are reviewed by the State Treasury personnel. You will be notified within 90 days if your claim is approved or if additional information is needed to complete the approval process.
- Wisconsin does not require that an heirfinder be licensed as a private investigator.
